Terms of Use

1. Agreement to Terms

By downloading, installing, or using Eight Angle (“the App”), developed by Brian Rohde (“the Developer,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 16 years old to use Eight Angle. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Eight Angle is an iOS application that uses on-device pose detection to help you track and improve your yoga practice. The App records practice sessions, detects yoga poses using machine learning, and provides feedback, statistics, and achievements.

4. Acceptable Use

You agree to use Eight Angle only for lawful, personal, non-commercial purposes. You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works based on the App
  • Use the App for any automated or non-personal purpose
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Use the App in any way that could damage, disable, or impair the service

5. Subscriptions and Billing

Free Tier

Eight Angle offers a free tier with limited features, including unlimited practice recording, basic statistics, and video export.

Additional features are available through a paid subscription. Subscription pricing is displayed within the App and in the App Store at the time of purchase. Prices are shown in your local currency and may vary by region.

Free Trial

A 7-day free trial begins after you complete your first practice session. During the trial, you have access to all paid features. After the trial expires, paid features require an active subscription.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period.

Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple in accordance with their refund policy.

Promotional Offer Codes

Eight Angle may offer promotional codes through Apple’s App Store offer code program. Offer codes are subject to Apple’s terms and conditions, are single-use, non-transferable, and may not be redeemed for cash. We reserve the right to discontinue offer code availability at any time without notice.

6. Intellectual Property

All content, design, graphics, code, and other materials in Eight Angle are owned by the Developer and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without prior written consent.

7. User Content

You retain full ownership of any practice recordings, images, and content you create using Eight Angle. The App allows you to export videos and images to your device’s photo library for your personal use. By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing App functionality (such as on-device pose detection and iCloud Sync). We do not access, view, or distribute your content.

8. Assumption of Risk and Health Disclaimer

Eight Angle is not medical advice. The App is intended for informational and tracking purposes only.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND ANY YOGA OR PHYSICAL ACTIVITY PERFORMED IN CONNECTION WITH THE APP IS AT YOUR SOLE RISK. You should:

  • Consult a physician or qualified health professional before beginning any yoga or exercise program
  • Not rely on the App as a substitute for professional medical advice, diagnosis, or treatment
  • Understand that pose detection is approximate and powered by machine learning, which may not always be accurate — do not rely on pose detection for physical safety or injury prevention
  • Listen to your body and practice within your own limits
  • Ensure your practice environment is safe and free of hazards

You voluntarily assume all risks associated with yoga and physical activity performed while using the App, including but not limited to risk of physical injury, strain, sprains, fractures, or death. You hereby release, waive, and discharge the Developer from any and all liability, claims, demands, and causes of action arising out of or related to any physical injury or harm sustained while using the App.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any physical injury or property damage resulting from your use of the App.

10. Disclaimer of Warranties

Eight Angle is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Pose detection results will be accurate or reliable
  • The App will meet your specific requirements
  • Any defects in the App will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, PHYSICAL HARM, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE APP SHALL NOT EXCEED THE LESSER OF (A) FIFTY DOLLARS ($50.00 USD) OR (B) THE TOTAL AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Dispute Resolution and Arbitration

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and the Developer agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (collectively, “Disputes”) will be resolved through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, rather than in court. The arbitration will be conducted in the State of California. The arbitrator’s decision will be final and binding.

Class Action Waiver

YOU AND THE DEVELOPER AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the jurisdiction of such court. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property or unauthorized access to the App.

30-Day Opt-Out

You may opt out of this arbitration provision by sending written notice to help@eightangle.com within 30 days of first downloading or using the App. Your notice must include your name and a clear statement that you wish to opt out of arbitration. If you opt out, Disputes will be resolved in the state or federal courts located in the State of California.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

You may stop using the App at any time. To cancel a subscription, use your Apple ID account settings.

14. Apple-Specific Terms

These Terms constitute an agreement between you and the Developer, not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

15. Export Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export laws and regulations when using the App.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Subject to the arbitration provisions in Section 12, any disputes not subject to arbitration shall be resolved in the state or federal courts located in the State of California.

17. Force Majeure

The Developer shall not be liable for any delay or failure to perform resulting from causes outside reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, power outages, internet or telecommunications failures, government actions, or failures of third-party services (including Apple, iCloud, or the App Store).

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be reflected on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify you through the App.
